These terms and conditions (the “Terms and Conditions”) governs the use of www.castle-b.com the “Site”. This Site is owned and operated by Castle Barbaste Corporation (the “Company”). This Site is an ecommerce website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
1. Purpose
The purpose of Castle Barbaste Corporation website is to present creations from artists (hereinafter the “Sellers”) to the users of the site (potential “Buyers”), and to give them the opportunity to discover and buy them online directly from the Company (the ‘’Distributor’’).
These general terms and conditions of sale are destined to define the terms and conditions for the online sale of the creations available on the site, and to define each party’s rights and obligations in such a relationship.
2. Acceptance
The unconditional acceptance of the entire general conditions of sale is mandatory to conclude the sale agreement, by both the Buyer and the Company. The acceptance is confirmed by a box that needs to be checked on the artwork order form.
3. Order
The creations are offered for sale on the Company’s website, subject to their availability. Each of the artwork offered comes with a short explanation containing information about its substrate, its dimensions, its weight, and type.
To order it, Buyers must select the Artwork of their choice, place it in the cart and provide the necessary personal information to place the order before validating the order, the Buyer must check the information appearing on the order summary, and can correct any potential mistakes in the items inserted, as well as read about the delivery costs.
If the Artwork is no longer available, an email informing the Buyer will be sent within 48 hours, cancelling the order.
4. Sales prices and Terms of payment
The creations sale price is listed on the Site in the Canadian currency and includes all taxes, excepting delivery and packaging fees if applicable.
The different methods of delivery and related costs are shown in the order summary. The delivery and packaging costs depend on the type of artwork, its dimensions, its weight, as well as the place of delivery.
The payment of the reproduction price made via the payment services available from credit card or bank transfer.
Transfer of ownership happens as soon as the full price has been paid by the Buyer. Failure to pay the full price automatically cancels the sale, and the creation is put back for sale on the company’s website.
5. Delivery
The delivery of the creations is made at the address provided on the order summary form, during the business hours.
Obligations regarding the delivery of the order, meaning respecting the given schedules, the quality of the packaging for the creation, as well as the conformity of the later are the sole responsibility of the Seller, the company shall in no case be held liable for failure to comply by the Seller.
As soon as the order is received the Buyer must check the condition of the artwork, and mention any reservation immediately and by email, at the latest within 48 hours to the company.
6. Statutory Guarantees
The Company commits to respect and implement the statutory guarantees of the Buyer, i.e.: the guarantee of non-compliance and the guarantee of hidden defects.
7. Intellectual Property
All contents published and made available on our Site are property of Castle Barbaste Corporation and the Site’s creators. This includes, but is not limited to images, text, documents, downloadable files, and anything that contributes to the composition of our Site.
The Company guarantees that the author of the conceded creation and that the later does not violate any laws, regulations, and standards in force, or affects the rights of third parties.
Upon the sale, the Company assigns to the Buyer the material substrate of the artwork and its representation rights on the artwork.
8. Force majeure
In case of a situation of force majeure, the execution of the contract/ transaction may be suspended or cause the cancellation of the sale.
Expressly, are considered cases of force majeure or fortuitous events, those usually acknowledged by the jurisprudence of the Canadian courts and tribunals, i.e., an event that is out of the control of the debtor, which could not have been reasonably expected at the time of the contract being concluded, and whose effects cannot be avoided by any appropriate measures.
The party invoking force majeure must immediately inform the other party, as well as upon its extinction thereof.
9. Accounts
When you create an account on our Site, you agree to the following:
1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

The Company gathers and retains the Buyer and the Seller’s personal data to ensure proper execution of these terms.
The Company reserves the right to retain certain data to justify, when necessary, the execution of their contractual or legal obligations.
Our company is devoted to take all necessary measures to best protect the confidentiality of the information provided by the Seller and the Buyer. Pursuant to the law Personal Information Protection and Electronic Documents Act, SC 2000 c 5 (‘PIPEDA').
The personal data provided by the Seller will be destroyed no later than six months after the cancellation of the account.
13. Applicable Law
These Terms and Conditions are governed by Canadian law.
14. Severability
If at any time any of the provisions exhibit in these Terms and Conditions are bound to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. Al other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
15. Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
16. Competent Jurisdiction
Any dispute concerning the validity, interpretation or execution of these General Conditions of Sale shall be brought before the Canadian Courts.
